1. Acceptance of Terms

Welcome to NeedsLink (at needslink.org), a platform owned and operated by the National Education Trust of Jamaica (NET). By accessing or using our platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

NeedsLink is a platform that connects individuals and organizations in need with donors, volunteers, and fulfillment partners. Our services include:

  • Posting and browsing needs listings
  • Creating and managing campaigns for community support
  • Facilitating connections between advocates, donors, and partners
  • Providing tools for need fulfillment tracking
  • Enabling communication between platform users

3. User Accounts and Registration

3.1 Account Creation

To access certain features of NeedsLink, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Types

NeedsLink supports multiple account types including advocates, donors, fulfillment partners, administrators, and sub-administrators. Each account type has specific permissions and responsibilities as outlined in the platform.

3.3 Age Requirement

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account.

4. User Conduct and Responsibilities

4.1 Acceptable Use

You agree not to:

  • Post false, misleading, or fraudulent needs or campaigns
  • Impersonate any person or entity
  • Violate any laws or regulations
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Attempt to gain unauthorized access to the platform
  • Interfere with the proper functioning of the platform
  • Collect or store personal data of other users without permission

4.2 Content Standards

All content posted on NeedsLink must be respectful, truthful, and comply with all applicable laws. We reserve the right to remove content that violates these standards or our community guidelines.

5. Needs and Campaigns

5.1 Posting Needs

When posting needs on NeedsLink, you represent and warrant that:

  • All information provided is accurate and truthful
  • You have the authority to request the stated needs
  • The needs are legitimate and will be used as described
  • You will update the status of needs as they are fulfilled

5.2 Fulfillment Commitments

When you commit to fulfilling a need, you agree to follow through on your commitment in good faith. Failure to fulfill commitments may result in account restrictions or termination.

6. Financial Transactions

NeedsLink facilitates connections but does not process financial transactions directly. Any donations, purchases, or financial arrangements are made between users directly. NeedsLink is not responsible for any financial disputes between users.

7. Intellectual Property

7.1 Platform Content

The NeedsLink platform, including its design, features, functionality, and content (excluding user-generated content), is owned by NeedsLink and is protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

You retain ownership of content you post on NeedsLink. By posting content, you grant NeedsLink a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting the platform.

8. Privacy and Data Protection

Your use of NeedsLink is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using NeedsLink, you acknowledge that your information may be processed in accordance with our Privacy Policy, which complies with applicable data protection laws in Jamaica and other jurisdictions.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

NeedsLink is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

  • The accuracy or completeness of information on the platform
  • The reliability of users or the fulfillment of their commitments
  • Uninterrupted or error-free operation of the platform
  • That defects will be corrected

9.2 Limitation of Liability

To the maximum extent permitted by law, NeedsLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to use the service in the past 12 months.

10. Indemnification

You agree to indemnify, defend, and hold harmless NeedsLink, its officers, directors, employees, and partners from any claims, liabilities, damages, losses, and expenses arising from your use of the platform, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the platform will immediately cease. You may also terminate your account at any time by contacting us.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the platform. Your continued use of NeedsLink after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica. The National Education Trust of Jamaica (NET) operates NeedsLink under Jamaican jurisdiction.

15. Refunds and Chargebacks

All donations, contributions, or payments facilitated through or in connection with NeedsLink are considered final and non-refundable unless otherwise required by applicable law or expressly determined by NeedsLink in its sole discretion.

NeedsLink may, but is not obligated to, authorize a refund in cases of duplicate payment, verified fraud, or technical processing error. Refunds are processed through the original payment method and are subject to third-party processor terms.

16. Use of Funds and Campaign Transparency

Organizers and advocates must use all funds received solely for the purposes stated in their campaigns or needs listings. They must:

  • Provide accurate and up-to-date information about how donations are used
  • Respond promptly to donor or platform inquiries
  • Maintain transparency throughout the campaign lifecycle

NeedsLink reserves the right to suspend or remove campaigns that fail to demonstrate transparency or appear to misuse funds.

17. Prohibited Uses and Content Rules

Users may not use NeedsLink to post, promote, or fund campaigns related to:

  • Illegal activities or violations of Jamaican or international law
  • Violence, weapons, or controlled substances
  • Gambling or pornography
  • Hate speech or discriminatory content
  • Misrepresentation of facts or fraudulent purposes
  • Infringement of intellectual property rights

NeedsLink may remove or disable access to any content or campaign that breaches this policy.

18. User Conduct and Moderation

All users must engage respectfully and responsibly. The following behaviors are strictly prohibited:

  • Harassment, abuse, or manipulation of other users
  • Attempts to disrupt the platform's operations
  • Any conduct that violates our community standards

Violations will result in immediate account suspension or termination. NeedsLink reserves the right to moderate, edit, or remove any content at its discretion to protect the integrity of the platform and community.

19. Intellectual Property and User Content License

Users retain ownership of all content they upload, including images, videos, and text. By posting content on NeedsLink, users grant the platform a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for:

  • Operational purposes
  • Promotional activities
  • Legal compliance purposes

Users represent and warrant that they have all necessary rights and permissions to post any submitted content.

20. Data Privacy and Visibility

NeedsLink collects and processes user data in accordance with its Privacy Policy. Certain user information may be publicly visible on the platform, including:

  • Campaign titles and descriptions
  • Donor names (where applicable and with consent)
  • Fulfillment statuses
  • Public profile information

Sensitive personal data will not be shared without consent except as required by law or to protect against fraud or misuse.

21. Dispute Resolution and Informal Negotiation

All disputes arising out of or relating to the use of NeedsLink shall be governed by the laws of Jamaica. Before pursuing formal arbitration or legal action, the parties agree to first attempt informal resolution by:

  • Contacting NeedsLink with a detailed description of the dispute
  • Engaging in good faith negotiations for at least 30 days
  • Working toward a mutually acceptable resolution

Failing informal resolution, disputes shall be settled through binding arbitration in accordance with Jamaican arbitration law.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and the National Education Trust of Jamaica (NET) regarding your use of the platform and supersede all prior agreements and understandings.

By using NeedsLink, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
